When can I grow cannabis at home in Thailand?

The decision allowing Thai households to grow marijuana was officially passed last Tuesday when Health Minister Anutin Charnvirakul signed a ministerial announcement endorsing the move to remove the plant from the list of Category 5 narcotics.

To shed some light on this matter, here are a few questions with answers.

Q: When can I start growing marijuana at home
Answer: Household planting can begin in the next 120 days, once the Royal Gazette announces that marijuana has been removed from the blacklist.

Q: Do I have to inform the authorities before growing it?
Answer: Before growing, inform the public health agency in your county about the number of marijuana plants you plan to grow, where exactly they will be grown, and for what purpose. The office will then forward the proposal to the Food and Drug Administration (FDA). You can’t start growing marijuana until the FDA has given the green light.

Q: What is the limit for growing marijuana at home?
Answer: Individual households can grow up to six marijuana plants. However, anyone who has registered with the government as a community enterprise (7 persons) can grow without restriction.

Q: What is the allowed use of homegrown marijuana?
Answer: People can grow marijuana at home for medical use and as an ingredient in other products. The sale of marijuana and its extraction for consumption is strictly prohibited to persons under 20 years of age, pregnant women, breastfeeding women and other persons, announced by the Ministry of Health.

Notably, a law to prevent the general misuse of marijuana products, including recreational use, has been passed by the House of Representatives and is pending Prime Minister’s approval.

Q: What are other restrictions on marijuana extraction/processing?
Answer: All extraction, processing, sale, import and export of marijuana must first be approved by the FDA. The concentration of tetrahydrocannabinol (THC) in marijuana products must remain below 0.2 per cent.

Q: Can I advertise my homegrown marijuana?
Answer: All forms of homegrown marijuana advertising are prohibited, except those approved by the FDA.

Q: What other plants are still on the Category 5 narcotic list?
Answer: Opium, psilocybin or magic mushrooms and cannabis extract with more than 0.2 per cent THC are still on the list of illegal drugs.
